These terms and conditions constitute a legally binding contract between the user / buyer / client and "the supplier" or seller, and this document is referred to as the terms and conditions. The buyer accepts these terms and conditions by making a purchase or placing an order with the supplier. These terms and conditions are subject to change without general notice. These terms and conditions apply to all transactions between the user and the supplier. They do not affect your legal rights. Please read carefully. We may change these terms and conditions at any time. Changes will take effect on the date they are published on our website. These terms and conditions are governed by applicable law. We do not accept amendments to these terms and conditions.

DEFINITION OF CUSTOMER

To order products on the website, you must be at least 18 years old and accept delivery. All online orders on our website are acknowledged electronically (via email); please note that no verbal acknowledgment constitutes an order confirmation or order acceptance.

Your order will be accepted, thereby creating a legally binding contract between you and us, and will be concluded once the goods have been shipped or collected and fully paid for. Alternatively, we may reject all or part of your order for any reason, in which case you will be informed by phone or email.

When deciding whether to accept your request, we may use certain information about you, including any credit checks received from the credit agency. This helps protect both you and us against fraudulent transactions. We will inform you if your payment information cannot be authorized for any reason and may invite you to pay by any other method. The total price to pay is stated at the time you place your order if the order has been acknowledged.

The site reserves the right to make price adjustments taking into account any supplier increases in the prices of our items, or the imposition of taxes or duties, or if due to an error or omission, the published price for the products is wrong or the order has not been acknowledged. We will inform you of the correct price and you will have the opportunity to cancel the order. All prices include taxes and delivery charges, which will be paid as indicated at the time of placing the order.

Our intention is that all information should be as accurate and up-to-date as possible. However, on rare occasions, we discover an error in the price or description of a product, and as such, we cannot guarantee the reliability or accuracy of the information communicated. If an error is discovered in a product you have ordered, we will inform you as soon as possible and ask if you wish to continue with your order or cancel it. All accessories supplied with a product are subject to update or change at the manufacturer's discretion. We will supply the product as provided to us by the manufacturer.

PAYMENT METHODS

To make online purchases, the customer needs a valid credit card issued in Mexico by Visa or MasterCard. When making a payment for an order on our site and after confirming the products you requested, you will be automatically connected to the credit processor where confirmation of the card number and security code will be requested. This process is carried out directly between the bank's credit authorizer and you. The successful conclusion of a purchase on our site does not imply acceptance of the transaction or order; this will be confirmed via email to the address you registered, once the respective charge is approved by the bank and the order has been fulfilled. You can also pay by check or bank deposit; the merchandise will be shipped until payment is received.
You must provide us with your exact billing address when placing the order. Your order will only be processed once authorization for your credit or debit card has been successfully received. You can also pay with cash sent by special mail. All goods and services are subject to availability and may be withdrawn at any time. If we are unable to supply the goods for any reason, we will not charge you for them and will refund any money already paid for them. However, we are not responsible for compensating you for any other loss you may suffer by not supplying the goods.

DELIVERY

In Mexico City and for in-stock materials, within 72 hours of payment.
For shipments to the interior of the Republic and for in-stock materials, 3 to 5 days.
For out-of-stock and imported materials, please confirm delivery time with your contact or at ventas@incom.com.mx.

Delivery will be made to the address you indicate between 8:00 AM and 8:00 PM, by our means or by a courier service specially contracted for the delivery of your goods. We will do our best to deliver the goods within the established deadlines. If you or a person authorized to receive the material is not found, we reserve the right to charge a second delivery fee.

WARRANTY

We strive to offer our customers exceptionally high-quality products. However, on rare occasions, these products may have manufacturing defects. In the event that your item is defective, please refer to our returns and warranty policy.

STATEMENT OF CONFORMITY

By completing a purchase with us, you agree to and accept the following terms and conditions:

1. The user/buyer/client fully agrees and understands that all items sold are strictly for legal purposes. I hereby swear and attest that I will not use any product for illegal purposes of any kind. Likewise, I hereby swear and attest that I am the legal owner of the products I have purchased on the website www.incom.mx and I understand that the seller disclaims all other representations, whether express or implied, including but not limited to, conditions of merchantability and/or fitness for a particular purpose.
2. By ordering the items, I automatically accept these conditions and, as the owner, I exclude all liability for any damages whatsoever, direct or indirect, caused by any use of the items. I declare that I have reviewed the laws of my state or location and I am free to legally possess any of these items, and I fully release the seller and all persons associated with the sale of these items from all liability that may arise from my order.
3. I understand that the seller is not responsible if a delivery address is incorrect and no returns or exchanges to me will be accepted if a lost package is the result of an incorrect address. I understand that once my order is placed, no address changes can be made.
4. Having read these terms, I accept the conditions of this agreement.

CLARIFICATIONS

1. The prices shown must be fully covered to Insumos Comerciales de Occidente S.A de C.V.
2. Does not include commission or other expenses that third parties may generate for the payment method/form used by the client. Any commission or expense generated by third parties must be covered by the client.
3. No refunds will be made on advances.
4. All cancellations incur a 20% penalty.
5. Changes and returns only within 15 calendar days after the material is delivered.
6. Cancellations or re-invoicing due to modification of tax data only within the month of the operation.
7. Customers with overdue balances will not be supplied with material.
8. Any breach of payment conditions will void the dates committed for outstanding order deliveries.
9. Prices and inventory subject to change without prior notice.
10. Delivery time begins upon firm payment and/or order confirmation.
11. Payment in pesos for invoices in dollars will be at the exchange rate of the Official Gazette on the day your payment is made.
12. The images shown are for reference; please request specifications from technical service.
13. Payment methods: deposit or transfer to bank accounts under the name of Insumos Comerciales de Occidente S.A de C.V.
14. The client is requested to include their order number as the Reference indicated in the deposit.
15. Accepted payment methods: Cards; VISA, Master Card, and American Express. Electronic means: Mercado Pago and Paypal.

SHIPPING COSTS

At the end of your order, find out if your shipping cost qualifies for the $99 peso promotion. This promotion covers a large number of products, with shipping nationwide.

The $99 peso shipping promotion applies to purchases of a single item or multiple items in your order.

Please check the specific details of each product when making your purchase to verify the applicable shipping rates.

PROMOTIONS

For cases determined by incom.mx, free shipping may be available depending on the amount and type of product. If the purchase qualifies for a $0 peso (no cost) rate, the phrase FREE SHIPPING will appear in the price breakdown or detail within the purchase order.

HEAVY PRODUCTS

In situations where the product exceeds our tariff limits, it is important for the customer to contact our support team to obtain a shipping rate quote.

Incom.mx does not offer automatic rates for products that exceed certain weight and volume limits in order to explore and select the most convenient shipping rates for the customer. Before processing orders that fall into this category, the support team will contact you to indicate the shipping rate cost. In most cases, the estimated time is 1 business day.

DEFINITION OF EXTENDED ZONE

An extended zone refers to postal codes to which parcel delivery companies have limited access and do not make regular deliveries. Generally, these areas are far from usual distribution centers. In these cases, it is very possible that for the same rate you can receive the material "ocurre" at the nearest carrier company office, where you will have to pick up the material.

EXTENDED ZONE VERIFICATION

If the shipping postal code is classified as an extended zone by the parcel services agreed upon by incom.mx, the added amount in the shipping rate will be notified through the contact method the customer provided in their purchase order (purchase form).

To determine if a postal code qualifies as an extended zone, we suggest our customers use this tool to check regular coverage zones and extended zones.

In cases of deliveries to extended zones, the customer can choose between one of the following options:

1. Accept the additional amount and make the payment to proceed with shipping.
2. Cancel the purchase and get a refund.
3. Pick up the material at the carrier's warehouse (ocurre mode).
4. Select a different delivery point where a regular shipping rate applies.
